I never thought I would cry over a moped...

Post by wikked_spree57 »

Until I wrecked my Dio 2 weeks ago. I was in the hospital for a week and a half... suprisingly only with a busted ankle and a fractured collar.

This is what happened - I was going down Dixie highway at around 30MPH. This * runs the red light at Dixie and King, and my front end hits his car. This sends me sailing to the curb breaking my ankle and fracturing my collar. The worst part was, I didn't cry cause I got hurt. I cried for real cause I sat up just in time to catch the other idiot run the same light (apparently they were racing) and SMASH into the * end of my Elite. Thus, this sent it through the air and up onto Independent bank's front lawn.

I was going to get it back from impound (yes, they impounded a totalled bike) but they wanted $180 and you can't even tell it's a scooter. The back wheel is mashed into the aluminum casing to the engine, frame is bent nearly in half, and it was just F****D up.

I seriously did cry. Like I said, not cause I was in pain. That scooter took me almost a hundred fone calls and 6 wasted trips to Lansing to get. Not to mention almost 2 years to find.

But not to despair, I see em for sale on here. When I'm ready to ride again I'll pay the long price for one that's in good shape. I'm opening a lawsuit against the driver of both vehicles, lawyer says case looks good. Asking for judgement of $15,000 for personal injury reimbursement and restitution. They think I will get it ;) So that will build a bad * bike!

The cost of replacing your rare, high dollar, collectible scooter should add a few $k more to your lawsuit. Normally what happens is your lawyer gets with the drivers insurance company. There are standard insurance tables for what various damage and injuries are "worth". They usually get it settled in about one phone call. I expect your scooter is consdered to be worth a couple hundred bucks. You need to make it clear that it wasn't just another $200 scooter that they ran over. Push to have them pay what is cost to replace it or have them find one for you.

Bro be thankful you're alive. DIO's are dime a dozen, but walking, talking, breathing on your own is a gift. I've been in many accidents and broke many bones. I thank God every day I make it home riding one of my 2 wheeled vehicles.

Regarding your lawsuit. Don't settle until atleast 1 year later. Dude, all the * up aches and pains don't show up until way way after the intial accident. It'd suck to settle for $15k and have to deal with a lifetime of unexplainable headaches, neckpain, and backaches.

I gone through what you are about to go through with your lawyer and the defendant. Just rack up those bills, save all receipts, nickel and dime everything that was lost, and figure out with your lawyer how much the other party got in assets and see what you can lawfully get.

Good luck and glad you're OK.

What he said, wait a couple months, your lucky to be alive. Add a few grand because the bike is "irreplaceable". Milk the * for all they got.
I am not a mechanic, nor do I play one on TV. Actually my advice is probably worth slightly less than what you pay to view it.

First, I'm with the other dudes - be thankful you weren't REALLY hurt. Second, I wish nothing but bad juju on the two sh*tBarfs who hit you and your bike. To me, something like that is no different than if they'd pulled a shotgun and blew you off your ride. F*cking cars are NO godam different than deadly weapons. Spudz don't get that - spudz shouldn't be allowed to drive 'em :Period. :x

Third - I'm no personal injury attorney but I play one on tv. Okay, that's not true - but THIS is:

Insurance companies get REALLY hinky when an open case is on their books. They want to settle, and settle fast - especially when an injury is involved. The longer you wait, the more $$ you can potentially get. And the more you get, the more your lawyer gets. He works for YOU, not vice versa.

So, DON'T settle right now. If you can hang in there, wait at least six months. Tell your lawyer you're in no hurry, need to visit some specialists, get some x-rays, maybe a CAT scan - whatever. The reason is, if you find out 12 months after the collision you've got something wrong with you, and you've already settled with the insurance company, well friend you be sh*t outta ruck.

Make 100% SURE you're okay, have been checked out and given a clean bill of health BEFORE you accept anything from the bastards' insurance company. And remember, your medical expenses will be REIMBURSED by those peckers, so don't let that worry you.

Okay. That's my advice for today. Be well and prosper. :)

15 Grand for broken bones, pain and suffering lost work wages and that's not including the future trips to the chirorpracter and Dr's, For some A@# Holes reckless driving. 15 grand is like them laghing in your face. I would not not settle for anything less than 75 and if you have a good lawyer you will get that and maybe more. Don't settle for the 15. Good luck.

The truth is that you can only get what they GOT. If they are brokeass losers, underinsured, no assets, unemployed, warrant for arrest, then fo real braddah you SOL.

But, by some gift from above, your lawyer finds out the guy owns a oil refinery and diamond mind in Africa, then go biitch slap yo boss, and start plans on your mansion in Hawaii, lolz.

Even if they don't have assets, you can garnish their wages fo eva! ...well as long they're working.
