what happens when you get caught?

well my friends spree just got taken away for exceeding the speed limit what do they do now?
do you get it back because he has all signed papers and keys.
the bore size was 82cc which exceeded the 50cc limit.

If he had his papers, why would they take it? Shouldn't you just get a speeding ticket?

idk they where saying that he couldn't modify his moped to go above 35+(he was going at around 40) do they disassemble your moped?

I've always wondered the same, everyone talks about them caring about motor size, but I doubt some cop will pull apart your motor and measure everything with calipers, then calculate displacement.
I do know of a few people the have gotten speeding tickets on modded peds, and they got to ride home afterwards (with a ticket, of course). My uncle even got ticketed on a bone stock jog, so it's not like speeding automatically means it's a modded motor.

thanks for the information I guess he has to go pick it up at the police station. next cruise is Gerald b cruise in jan and he was test riding the new bore, so he got paranoid.

Unless your state, city or whatever has a Constitution violating law that skips due process only the court can confiscate it. The cops can hold it for evidence but * it is a piddly * misdemeanor at most and shouldn't be turned into a federal case. Then again you might need a lawyer that knows the law to stop the jack booted thugs. Cops violate the law all the time, mainly because they THINK they know the law when in all reality they don't no jack. I never heard of anyone confiscating a scooter for any reason here.

the moped was impounded. they dont keep it, he has to pay more fines to get it back
cops are doing their job, they will look for anything to bust law brakers with and these moped laws are real.
its not hard to get a motorcycle license, especially with a little moped...the driving test will be e z =)

I was once pulled over with an unregistered moped, I played innocent and the cop just gave me a warning
I was riding on the sidewalk
you gotta be super aware and nice to cops, they will not hesitate to do something drastic as the youtube videos show

A motorcycle license won't make a difference, the laws are concerning overall speed, not whether you have a license or not.
And you need something motorcycle sized bike (not a moped) to take the test, if you use a big scooter there is a "belt driven" restriction which says you can't ride anything with a clutch.

I can't argue that. Although I've heard of "Not to exceed 49cc, not to exceed 35mph" in other places too.

Iowa has a 30MPH rule but no size limit anymore.

Iowa has cool laws...just dont go over 30!

"Legal Definitions
As defined by Michigan lawmakers, a moped has an engine displacement of 50 cubic centimeters or less, two-brake horsepower or less, and is unable to reach 30 mph or higher on a flat service.
If it a vehicle exceeds any of these qualifications, it's classified as being a motorcycle."
plus you gotta be atleast 15 yrs old...If i ever decide I want a bigger engine displacement I just need to get a motorcycle license...
