I buy scooter
Pay to have it shipped
it arrives at a close friends auto body shop.
close friend knew it was to arrive but had no idea of condition.
signs for scooter.
I get there and notice all sorts of damage
pg pipe all smashed up, scoot is not sitting correctly on stand
rear wheel barely moves..I think they dropped it at considerable height.
Seller writes a damage claim and helps me out as much as he can.
Seller calls me today saying FedEx refuses claim due to signer (my friend) signed for the item.
fedex states my friend (signer) should've kept the FedEx driver there throughout the complete assembly of scoot, then filled with fluids etc and completely checked it out. Who would do that? how would my buddy know if the scooter had a banged up pipe or if I bought it that way? It was wrapped up tight, why would my friend think anything was wrong if it didn't appear to be damaged.

Did the driver expressly state what your friend was signing for? If not, you have a case. I have never had a driver actually tell me that I was signing to say that the item was in satisfactory condition when I received it.

Good luck with getting the driver to stay there while you unpack, assemble, fill with fluids and run the thing. That is also why I don't use FedEx or UPS, they are both "Ultimate Package Smashers." Keep pressing them and threaten a lawyer and if they don't pay up get a lawyer and not only sue them for scooter damages but damages for pain and suffering for not bring able to rid your scooter. Oh and don't forget to sue for the lawyers fees too. *, I've seen a simple letter (3 short paragraphs) from a lawyer (cost me $50) make a Police Department change one of their moronic and illegal policies.

well first question. was the bike in good condition before it got sent over?

I bought it from Ty (c3killer) right here in the for sale section. A real straight shooter dude who has helped a ton. He showed me pictures that are still up in the for sale section that were taken a day before the ad and it was perfect. Ty couldn't believe the pictures I sent him. He strapped the scooter to a skid, removed front body and wheel and strapped everything down Then shrink wrapped it very good too. So, fedex required a business so my good bud owns a shop and is open during business hours. I just told my friend a scooter was on its way. I mean what, FedEx now requires all signers of packages to inspect 100% of everything to avoid responsibility, including getting a motor running while the driver awaits?

Like I said before, Good luck getting the drive to wait while you unpack it, because there is no way in * he will finish his route if he does and I know for a fact they have to finish their route. I agree with Bear, I used to be a delivery driver and I would never wait for someone to inspect their stuff. If anything is broken you have to make a claim regardless, there is absolutely nothing the driver can do, so why wait?

I get * off when I hear stories like that. I once had a friend send me a scooter frame from UPS, and I heard the m*thereffer 'DROP' it on my front porch.
